The former Chairman of the National Human Rights Commission, NHRC, Prof Chidi Odinkalu, has reacted to the decision of the Federal High Court refusing to grant a restraining order requested by the governor of the Central Bank of Nigeria, CBN, Godwin Emefiele against the Independent National Electoral Commission, INEC, and the Attorney General of the Federation, AGF, on his presidential ambition.
Emefiele had, through his counsel, Mike Ozekhome SAN, applied for an order of status quo ante bellum to be made against INEC and AGF so that he would not be made to resign from office until 30 days to the general election.
In an ex-parte application argued on Monday, Emefiele denied being a political appointee but a public servant not caught by Section 84 (12) of the new Electoral Act 2022.
However, Prof. Odinkalu described the Federal High Court’s decision as refusal to do evil.
He tweeted, “This morning, in Abuja, @OzekhomeMike filed an application seeking an ex parte order in the Fed High against @inecnigeria & #AbubakarMalami, to enable @GodwinIEmefiele run for @OfficialAPCNg tkt. He didn’t join #APC. Judge has just refused refused to do evil. Next date 12th”
He went ahead to describe Emefiele and Ozekhome as evils. He alps questioned Mike Ozekhome’s claim of being a constitutional lawyer.
He said, “Notice this malpractice & see that these ppl are evil: @OzekhomeMike on behalf of @GodwinIEmefiele wants an order against @OfficialAPCNg but he only sues @inecnigeria & the #HAGF, who have nothing to do with #APCPrimaries. 2mrw, Mike will tell us how he is #ConstitutionalLawyer!
“By the way, court in Abuja importantly has told @GodwinIEmefiele to “maintain #StatusQuoAnte”.
If he goes on to enter the APC Presidential race, he will be in breach of a court order. The deadline is tonight. Let us see how they finesse this.”
