Appeal Court Dismisses APGA’S N500m Suit Against Fidelity Bank

A Kano magistrates’ court presided over by Aminu Muhammmad Gabari has varied the bail conditions earlier granted the suspended Chairman of the Kano State Public Complaints and Anti-Corruption Commission, Muhuyi Magaji Rimin Gado following an application by his counsel, Muhammmad Dan Azumi.

Gado is standing trial on allegations of giving false information contrary to Section 140 (a) of the Penal Code.

The court had on April 29, granted him N500,000 bail with two sureties in like sum with one of them his father or an uncle who shall produce three years tax clearance or surrender his passport.

The second surety, according to the court, shall be either an Imam of Jaen Friday Mosque or the Village Head of Jaen.

In an 11-paragraph affidavit, Dan Azumi informed the court that the father of the defendant was dead.

“By the provision of Section 173 of the ACJL 2019, it is mandatory to admit a defendant to bail if his punishment doesn’t exceed three years imprisonment.”

He, therefore, prayed the court to accept the defendant’s brother and the Imam of Rimin Gado as sureties.

The magistrate, while dismissing the objection of the prosecuting counsel, Wada Ahmad Wada, said the court had the power to vary bail conditions.

He accepted the defendant’s brother instead of his father or uncle as the first surety and any recognised member of the society as the second surety.
